JOBS Act Creates Marketing Opportunities for Hedge Funds

The Jumpstart Our Business Startups (JOBS) Act of September 2013 has changed the parameters of hedge fund marketing. Previously, hedge funds were barred from public solicitation, even from their market of wealthy accredited investors. But the JOBS Act legalized public solicitation of investments in private companies, and this right-to-advertise extends to hedge funds. Thus far, few hedge funds has done so, but fund managers have taken to social media – something that was virtually unthinkable prior to the JOBS Act’s loosening of restrictions.
