Literally nothing new here past what Ted already quoted - Vanguard filed a motion to dismiss the suit. (Well, the last paragraph in the article adds that Danon has until Nov 17 to respond.)
The trial court threw out the case, saying that the former lawyer for Unilab/Quest couldn't sue. The appeals court agreed, not precluding anyone else from suing.

The Quest case cited by Vanguard is interesting. Unilab (later bought by Quest) undercharged medical care organizations (like HMOs and Independent Practice Associations) for lab tests to get them to send Medicare patients their way.
