Vanguard Seeks To Get Suit Thrown Out

Vanguard Group, the Malvern mutual fund giant, wants a New York court to throw out a tax-fraud lawsuit that challenges the company's legal structure.
It alleges that David Danon, the ex-Vanguard lawyer who filed the complaint, violated basic rules of corporate lawyer behavior by accusing his former bosses

  • Literally nothing new here past what Ted already quoted - Vanguard filed a motion to dismiss the suit. (Well, the last paragraph in the article adds that Danon has until Nov 17 to respond.)

    The Quest case cited by Vanguard is interesting. Unilab (later bought by Quest) undercharged medical care organizations (like HMOs and Independent Practice Associations) for lab tests to get them to send Medicare patients their way.

    The trial court threw out the case, saying that the former lawyer for Unilab/Quest couldn't sue. The appeals court agreed, not precluding anyone else from suing.

    Here's a pretty good writeup of the Quest case - you can skip to the last five paragraphs (each one sentence long) for the ruling against the lawyer suing his former client.
